1. Introduction

Welcome to the Intigate Technologies Private Limited ("Intigate", "we", "our", "us") platform. These Platform Terms of Service ("Terms") govern your access to and use of our WhatsApp Business API services, automation tools, and related software products. By registering an account or using our platform, you agree to be bound by these Terms.

Intigate Technologies Private Limited is a registered company in India and an authorized Meta Tech Provider under Meta's Business Platform Program.

2. Eligibility

• You must be at least 18 years of age to use this platform.
• You must have the legal authority to bind your business to these Terms.
• You represent that your use of the platform complies with all applicable laws in your jurisdiction.
• Businesses operating in sectors restricted by Meta's Prohibited Content policies are not eligible.

3. Platform Services

Intigate provides access to the following services:

• WhatsApp Business API integration and messaging infrastructure
• Chatbot and automation workflow tools
• Campaign management and broadcast messaging
• Analytics and reporting dashboards
• API access for custom integration
• Embedded Signup and WABA (WhatsApp Business Account) onboarding

4. Acceptable Use

You agree to use the platform only for lawful purposes and in accordance with Meta's WhatsApp Business Policy. You shall not:

• Send unsolicited bulk messages (spam) or messages to users who have not opted in
• Use the platform for phishing, fraud, or deceptive practices
• Transmit malicious code, malware, or harmful content
• Violate the privacy rights of any individual
• Circumvent rate limits, quotas, or API restrictions
• Resell or sub-license access to the platform without written consent from Intigate

5. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately via www.intigate.co.in/contact in the event of any unauthorized access. Intigate is not liable for losses arising from unauthorized use of your account.

6. WhatsApp & Meta Policy Compliance

As a Meta Tech Provider, Intigate operates under Meta's Platform Terms and WhatsApp Business Policy. All users of this platform must independently comply with:

• Meta's WhatsApp Business Policy
• Meta's Platform Terms
• WhatsApp Commerce Policy for transactional messaging

Intigate reserves the right to suspend accounts that violate Meta's policies without prior notice.

7. Fees & Billing

Certain features of the platform are offered on a subscription or pay-per-use basis. Pricing is communicated at the time of plan selection. All fees are exclusive of applicable GST and taxes. Intigate reserves the right to revise pricing with 30 days' prior notice to registered users.

8. Intellectual Property

All software, content, and technology on this platform remain the exclusive property of Intigate Technologies Private Limited. You are granted a limited, non-exclusive, revocable license to use the platform solely for your business purposes. Nothing in these Terms transfers ownership of any intellectual property to you.

9. Limitation of Liability

To the maximum extent permitted by law, Intigate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total liability for any claim shall not exceed the fees paid by you in the three months preceding the claim.

10. Termination

Intigate reserves the right to suspend or terminate your account at any time for breach of these Terms, violation of Meta's policies, or fraudulent activity. Upon termination, your right to access the platform ceases immediately.

11. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
